When you think about planning your estate, there are two important questions to answer: Who do I want to receive my assets after death, and what is the best way to get those assets to them?

Most people generally know that it is a good idea to "avoid probate." Some assume that executing a Last Will and Testament will accomplish this, when, in fact, a Will is simply a roadmap for the Probate Court to follow.

Others assume that estate planning must be expensive. Maybe they have heard that they MUST have a trust in order to accomplish the best plan for asset transfer following death.

The truth is, there is no "one size fits all." For instance, a trust can be very helpful if you have children and don't think it wise to have them receive their share of the estate the day they turn 18. And you usually don't want the Probate Court to dictate how that money is spent until then.

On the other hand, if you have only adult children, it may make sense to use a transfer on death designation on the asset. Doing this will not cost you a penny!

Every estate is different. That's why it's wise to seek an attorney for advice. But unless you have an extremely large amount of assets or a very complicated family situation, your estate can usually be planned for a cost of between $350 and $2,000.00.
